This Privacy Policy ("Policy") describes how CANiK USA, LLC collects and uses personal information when you access our website as well as any online communications; e-mails; and warranty registrations (E-Comms). California and Virginia have unique policies discussed below.
1. Information We Collect
When you use our E-Comms we collect personal information, which is information that identifies you, or that, along with other information, can identify you.
(I) Information You Provide to Us
We collect personal information when you use our E-Comms. We do not require you to provide any personal information to navigate our websites. We collect information from you when (1) you provide it voluntarily to us in response to a request for information, and (2) automatically when we need to communicate with you electronically. For example, we may request your: name, birth date, gender, company name, physical and billing addresses, e-mail addresses, telephone numbers, and zip code. We also collect credit card information. We collect commercial information about products purchased or considered, and purchasing histories. Information obtained through application usage consists primarily of anonymous statistics but also includes "Cookies." For proper functionality of the E-Comms, a minimum of anonymous usage data and first-party Cookies are collected.
(II) Information We Get from Third Parties
We may provide links to social media platforms. These third-party applications may collect information about your IP address, and they may set Cookies for the purposes their third-party applications as described in their privacy policies. Your use of those applications is governed by the privacy policies of the companies that provide them, and not by this Policy.
(III) Information Collected Automatically
We may collect internet or electronic network activity about you and your use of our E-Comms whenever you use the E-Comms. For example, we may collect information about your IP address, your user behavior, E-Comms traffic statistics, operating system, and browser type. This data generally does not personally identify you and is automatically collected (as third-party Cookies) when you use our E-Comms. This anonymous information is helpful for marketing purposes and improving our customer service experience.
(IV) Cookies and Other Tracking Technologies
Cookies enable us to personalize your viewing experience. When you revisit our internet pages, we can recognize you by the Cookie and customize your experience accordingly.
2. How We Use Your Information
We use your personal information to improve our E-Comms and products, and to protect our legal rights. We limit the collection of personal data for these legitimate purposes.
We process your information for the following purposes as necessary to:
- Fulfill your orders.
- Improve products and services.
- Communicate with you.
- Provide customer support.
- Maintain and improve our E-Comms.
3. Security
The security of your personal information is important. We maintain reasonable industry-standard security measures to protect and limit access to your personal information. No method of electronic transmission is perfectly secure. Even though we use industry acceptable measures to protect your information, no one can guarantee its absolute security.
4. California Privacy Rights
If you are a resident of California ("California Consumer"), you have certain rights, including but not limited to the collection, use, correction, deletion, transfer, and processing of your "Personal Information", as defined by the California Consumer Privacy Act of 2018 (and as amended by the California Privacy Rights Act of 2020) and any applicable regulations ("CCPA"). Any capitalized terms not otherwise defined in this Section 4 of the Policy shall have the same meaning given to them in the CCPA. We reserve the right to limit these rights where permitted under applicable law, including where your identity cannot be reasonably verified or to the extent your rights adversely affect the rights and freedoms of others. Only you or a person that you authorize to act on your behalf, may make a request related to your Personal Information.
A. Our Collection and Use of Personal Information
You have the Right to Know what Personal Information we may have collected about you within any given 12-month period. As a general matter, within the 12-month period preceding the last update of this Policy, we may have collected the following categories of Personal Information about you:
- Your Online Activity: While browsing our website, we may have collected information about your internet and other network activity including but not limited to your browsing history, your search history, and your interaction with our applications, websites, and advertisements.
- Your Identifiers: Identifiers can include, but are not limited to, your real name, IP address, unique personal identifiers including but not limited to Cookies, beacons, device identifiers, pixel tags, and other similar identifiers, and email address.
We do not collect any Personal Information that would be considered Sensitive Personal Information under the CCPA.
In the preceding twelve (12) months as of the last update to this Policy, we have not sold Personal Information about consumers; this includes, but is not limited to, Personal Information of minors under sixteen (16) years of age.
In the preceding twelve (12) months as of the last update to this Policy, we may have used your Personal Information for any purposes specifically described on our website (including any associated apps and E-Comms) and for the following business purposes as specified in the CCPA:
- To better understand how visitors use CANiK USA, LLC's E-Comms;
- To enhance the online experience of visitors;
- To provide you information;
- To perform E-Comms and associated analytics;
- To detect and resolve security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and associated legal prosecution; and
- To identify and repair errors that may impair website functionality and experience.
B. Third Party Disclosure of Personal Information
In the preceding twelve (12) months as of the last update to this Policy, we may have disclosed your Personal Information as indicated below for those business purposes outlined in Section 4(A) above:
- Vendors, consultants, and others who provide E-Comms to you on our behalf — Identifiers and Online Activity
- Data analytics providers, and data marketing service providers, third party web analytics providers — Identifiers and Online Activity
In addition, we may also share your Personal Information as required pursuant to applicable governmental requests and law enforcement requests, or as otherwise may be required pursuant to applicable law or regulation.
C. California Consumer Individual Rights
(I) Rights to Access, Correction, Deletion, and Opt-Out of Sale or Sharing
You have the right to request what Personal Information we collect, use, and disclose about you to third parties, as well as other rights regarding the use, access, accuracy, and sharing of your information including:
- Access: You have the right to request, twice in any given 12-month period, that we disclose to you any Personal Information that we may have collected, used, disclosed, and sold about you.
- Correction: You have the right to request that we correct inaccuracies within the Personal Information that we have collected about you. We may, however, deny certain requests, or only partially fulfill a request if required pursuant to other legal rights and obligations we may have.
- Deletion: You have the right to request that we delete Personal Information we collected from you, subject to applicable legal exceptions that may otherwise apply to us. We may, however, deny certain requests, or only partially fulfill a request if required pursuant to other legal rights and obligations we may have. We may take reasonable steps to verify your identity as described in the Policy, and request confirmation from you prior to deleting your Personal Information.
- Opt-Out of Sale or Sharing: You may also opt-out of the sale of your Personal Information or the sharing of your Personal Information for advertising; however, we do not sell or share Personal Information for cross-context advertising.

(III) Verifying Requests
California Consumers can submit requests through our telephone number and our email address. We must verify that the person requesting information or deletion is the California Consumer about whom the request relates to process the request. To verify a California Consumer's identity, we may request up to three pieces of Personal Information about you when you make a request to compare against our records. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in your request to verify your identity and will delete any information you provide after processing the request. We reserve the right to take additional steps to verify the identity of California Consumers where we have reason to believe a request is fraudulent.
(IV) Authorized Agent
Consumers may use an authorized agent to submit their request. The authorized agent must be registered with the California Secretary of State and be authorized to submit requests on behalf of a consumer. If you are an authorized agent and a consumer has given you signed permission to submit a request on his or her behalf, please send a copy of your signed permission by the consumer to us. Failure to submit proof of signed permission may result in us denying the consumer's request. We will require the consumer to verify his or her identity and directly confirm with us that they provided you with permission to submit the request.
(V) Right to Equal Service
We will not discriminate against you because you exercised any of your rights, including, but not limited to, by:
- Denying goods or E-Comms to you.
- Charging different prices or rates for goods or E-Comms, including by discounts or other benefits or imposing penalties.
- Providing a different level or quality of goods or E-Comms to you.
D. California Privacy Rights: Shine the Light
Under California's "Shine the Light" law, California residents who provide certain Personal Information in connection with obtaining products or E-Comms for personal, family or household use are entitled to request and obtain once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include customer information and the names and addresses of those businesses with which we shared customer information for the prior calendar year.

Please be aware that not all information sharing is covered by the "Shine the Light" requirements and only information on covered sharing will be included in our response.
5. Virginia Privacy Rights
If you live in Virginia ("Virginia Consumer"), you have certain rights, including but not limited to the collection, use, correction, deletion, transfer, and processing of your personal data pursuant to the Virginia Consumer Data Protection Act of 2022 and any applicable implementing regulations (collectively the "VCDPA"). Any capitalized terms not otherwise defined in this Section 5 of the Policy shall have the same meaning given to them in the VCDPA.

We do not collect any personal data that would be considered "sensitive" under the VCDPA.
We may use your personal data for any purposes specifically described on our website (including any associated apps and E-Comms) and for the following business purposes:
- To better understand how our visitors use CANiK USA, LLC's E-Comms;
- To enhance the online experience of our visitors;
- To provide you information pertaining to us;
- To perform E-Comms and associated analytics;
- To detect and resolve security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and associated legal prosecution; and
- To identify and repair errors that may impair website functionality and experience.

C. Virginia Consumer Individual Rights

- Access: You may have the right to request the personal data that we collected, used, disclosed, and sold about you. If you request this information more than twice in any given twelve (12) month period, we may charge you a fee to answer your request.
- Correction: You have the right to request that we correct inaccuracies within the personal data that we collected about you. We may, however, deny certain requests, or only partially fulfill a request if required pursuant to other legal rights and obligations we may have.
- Deletion: You have the right to request that we delete personal data we collected from you, subject to applicable legal exceptions that may otherwise apply to us. We may, however, deny certain requests, or only partially fulfill a request if required pursuant to other legal rights and obligations we have. We may take reasonable steps to verify your identity as described in the Policy, and request confirmation from you prior to deleting your Personal Data.
- Opt-Out of Sale: You may also opt-out of the sale of your personal data; however, we do not sell any personal data.
- Opt-Out of Targeted Advertising: You may also opt-out of the processing of your personal data for purposes of targeted advertising; however, we do not process any personal data for targeted advertising.

(III) Verifying Requests
We provide Virginia Consumers with the ability to submit requests through our telephone number and our email address. We must verify that the person requesting information or deletion is the Virginia Consumer to process the request. To verify a Virginia Consumer's identity, we may request up to three pieces of personal data to compare against our records. We cannot respond to your request or provide you with personal data if we cannot verify your identity. Making a verifiable consumer request does not require you to create an account with us. We will only use personal data to verify your identity and will delete any information you provide after processing the request. We reserve the right to take additional steps to verify the identity of Virginia Consumers where we have reason to believe a request is fraudulent.
(IV) Authorized Agent
Virginia Consumers may use an authorized agent to submit their request. If you are an authorized agent and a Virginia Consumer has given you signed permission to submit a request on his or her behalf, please send a copy of your signed permission by the Virginia Consumer to us. Failure to submit proof of signed permission will result in a denial of the Virginia Consumer's request. We will require the Virginia Consumer to verify his or her identity and directly confirm with us that the consumer has provided permission to submit the request.
(V) Appealing Rejected Requests
If we reject your request, you will receive a notification with the reason or reasons for the request's rejection and instructions concerning how to make an appeal. If you choose to make an appeal, it must be submitted within fifteen (15) days of your receipt of the rejection notice. We will then respond to your appeal within sixty (60) days of your having submitted it to us.
6. Children's Privacy
Our websites and E-Comms are not intended for use by children. We do not knowingly collect personal information from children under the age of sixteen (16) years. If we become aware that a child under sixteen (16) has provided us with personal information, we take steps to delete such personal information without undue delay. The use of our E-Comms for purchases is intended for persons twenty-one (21) years of age and older.
7. Third Party Website Links
This Policy applies solely to our E-Comms. Our E-Comms may contain links to websites owned or operated by third parties. Your use of third-party websites is done at your own risk and subject to any terms and conditions of use, privacy policies, and other practices or procedures for such websites. We are not responsible or liable for the content of or your use of any third-party websites that you may access through links on our E-Comms.
8. SMS/Mobile Information Privacy
When you provide your mobile phone number and opt in to receive SMS or text messages from CANiK USA, we collect and use your phone number solely for the purpose of sending you account notifications, warranty updates, support ticket responses, and other transactional communications.
Your mobile information, including your phone number, will not be sold, rented, or shared with third parties or affiliates for promotional or marketing purposes.
